Colorado City Passes Scary Gun Legislation. Retaliation Lawsuits Pending

If you love your guns (and you’re reading this, so I’ll assume that you do), then don’t move to Boulder, Colorado. Why? Because the Boulder City Council has, apparently, been smoking too much of the legal marijuana in that state, and it has twisted their thinking on guns.

What exactly did they do? They unanimously passed very restrictive gun control ordinances even though, as one city council member put it, they expect to be sued for it.

It doesn’t sound like they’ve really thought this through, does it?

The Boulder City Council unanimously passed a sweeping gun control ordinance Tuesday night banning “assault weapons” and bump stocks, even as a pro-Second Amendment group threatened to retaliate by suing individual councilmembers.

In a surprising turn, one Colorado councilwoman admitted that she disagreed with the ordinance “in many ways,” saying it would invite a flood of litigation — despite voting for it.

The city defines assault weapons as “semi-automatic firearms designed with military features to allow rapid spray firing for the quick and efficient killing of humans.”

Included in the definition are “all semiautomatic action rifles with a detachable magazine with a capacity of twenty-one or more rounds,” as well as “semiautomatic shotguns with a folding stock or a magazine capacity of more than six rounds or both.”

But, lest you think that the passing of the ordinance is the end of the issue, think again. Again, from Re:

During the public comment period for the legislation, the nonprofit Mountain States Legal Foundation promised to sue the city for “violations of the Second, Fifth, and Fourteenth Amendments,” as well as the Colorado Constitution, Fox’s KDVR-TV reported.

A staff attorney for the group, Cody Wisniewski, said that individual councilmembers would be named in the lawsuit, according to the network.

I like Mountain States Legal Foundation’s thinking on this lawsuit. While they may not be able to hold councilmembers responsible for unconstitutional government actions, civil lawsuits can still help to bring the sting of personal responsibility against politicians who abuse their authority, such as in this case.

Regardless, though, you may want to stay away from Boulder for the time being if you want to carry to protect yourself and your family.

Sue their asses , and vote them out next election . they can only get away with this crap if people lay down and take it! i used to spend a fair amount of time in Colorado . it is a shame that it is going the way of calif. Colorado seems to be well on its way to becoming a den of mindless , liberal nitwits.

    • As a Colo resident, I can assure you the reason these people are in office is the fact that the people from the country of Boulder elected them in the first place, this place is a place of its own making.

  2. “….shall not be infringed.” I’m wondering where the city council gats the idea that they have the authority to ban any type of weapons? Allowing cities to make up gun laws will result in a total hodge-podge of laws. If someone were to drive across country, they could go from being perfectly legal to being a felon simply by crossing a city limit! Our constitution never gave cities any such authority!

  3. Back in about 2000, Boulder tried to pass an ordinance that one must transport a firearm in a locked case with the word “FIREARM” painted on it in red letters at least 14″ tall. Even to transport from your house to your vehicle. It did not pass.

  5. If the people would start recalling these morons maybe this country would get back to normal. These “politicians” are people too and they need to remember that they work for us. Maybe we should lower the amount of money these guys get and see how long they want to stay in the political ring. Not long I suppose.

  6. Such legal behavior by the City of Boulder is a signal of mindless thought on their part. While the AR-15 does give potential advantage in some attacks, any semi-automatic weapon including shotguns, can be fired and reloaded faster than other firearms. But any semi-automatic firearm can be fired faster than any other type of weapon. However, the lever action rifle can be fired a lot faster faster than a bolt action firearm. Even so, when a school allows anyone to wear or carry any time of clothing or accessory case to get a weapon past scrutiny is asking for trouble. Therefore, metal detectors have to be placed on every door the permits entry/exit by anyone of any age. Furthermore, such metal detectors need to be well in advance of an unlocked door to allow for the door to be locked.

  7. Just a question. When will it happen that someone finally takes their oath to the constitution and start taking the enemy of the people and constitution to task? When it starts, in my opinion, I believe it will start with the shooting of cops coming for someone’s firearms or politicians that are against the constitution, last but very possible media, cause they’re killing them in Mexico now. Wait and see.

  9. To describe the mental processes the Bolder City Government indulged in as “thinking” strains credulity, aside from being overly generous.

  10. Colorado is a beautiful state, or it was until they went crazy liberal. I’ve never lost anything in Colorado, and with the way they are going I’ll never be in that state to lose anything.

  11. So why can’t individual councilmen be criminally sued for the legislation they individually voted for? The SCOTUS ruling that corporations and governments are legal persons is a bunch of crap! It’s the people behind corporations and governments that are responsible for bad actions. That makes those people criminally liable.
