It’s not everyday that you hear about a lawsuit lasting 26 years, but, apparently, that’s how long it took for the city of Gary, Indiana to get its day in (appeals) court.
That length of time for a court case is pretty bizarre, if you think about it, but in this case, I’m okay with it because, to disagree with Donald Trump, at least when it comes to the Second Amendment, I never get tired of winning.
Sure, I’d like to have all gun control wiped away once and for all and be done with it. The entire country and the entire world would be better for doing that.
But until that time, I’m happy to keep on winning when it comes to gun rights, and, fortunately, we’ve been getting to see more and more of that over the last few years.
So, back to the Gary, Indiana lawsuit, Michael Clements gives us the details:
A three-judge panel of the Indiana Court of Appeals ended a 26-year-old lawsuit filed by the city of Gary against several gunmakers that accused the firearms industry of complicity in violent crime involving guns in the city.
The court ruled that a 2024 law retroactively limits the right to file such legal actions to state government, reversing a lower court’s ruling that the law was unconstitutional.
According to the Appeals Court ruling, House Enrolled Act 1235 (HEA 1235), which was signed into law on March 14, 2024, states that “only the state of Indiana may bring or maintain an action by or on behalf of a political subdivision against a firearm or ammunition manufacturer, trade association, seller, or dealer.”
Of course, anti-2A groups like Brady were upset because a lawsuit trying to hold manufacturers responsible for the actions of people using products that the manufacturer made was thrown out of court.
But there aren’t many other arenas in which you would be held liable for the actions of someone who bought something from you (or, in the case of many criminals, stole from you). It makes absolutely no sense for any lawsuit to even make it to court for this type of thing.
Then again, that’s exactly why anti-2A activists file these suits: they don’t make any sense, just like gun control doesn’t make any sense once you understand how the world works.
