I don’t know about you (since you’re reading this, though, I’ll assume that you agree with me), but I’m sick and tired of Joe Biden and his anti-2A cronies trying to trample our rights as Americans. What makes it worse is that anti-2A politicians and their bootlickers in the mainstream legacy media constantly take data out of context (if not outright lying about it) to push their agenda to take our guns.
Which is one of the reasons that I love it when a court smacks the gavel down and destroys a gun control scheme. Because, when that happens, even anti-2A politicians’ lying can’t give them what they want or take away our rights.
And that just happened. Zachary Stieber writes,
Restrictions imposed by President Joe Biden’s administration on so-called ghost guns are illegal, a federal appeals court ruled on Nov. 9.
The U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), an Executive Branch agency that promulgated the rule containing the restrictions in 2022 with President Biden’s support, overstepped its authority, according to a panel of the U.S. Court of Appeals for the 5th Circuit.
“The agency rule at issue here flouts clear statutory text and exceeds the legislatively-imposed limits on agency authority in the name of public policy,” U.S. Circuit Judge Kurt Engelhardt wrote in the ruling. “Because Congress has neither authorized the expansion of firearm regulation nor permitted the criminalization of previously lawful conduct, the proposed rule constitutes unlawful agency action, in direct contravention of the legislature’s will.”
Stieber continues:
“We are elated with this unanimous court ruling,” Alan Gottlieb, founder and executive vice president of the Second Amendment Foundation, which is one of the plaintiffs, said in a statement. “The ATF clearly exceeded its authority. This is a major victory for gun owners and the rule of law.”
This is great news for people concerned about personal liberty, government overreach, and about the right to be able to defend ourselves and our families.
And this is exactly the way all attempts at gun control should be handled: destroy those gun control laws completely.
These clowns constantly ignore the law, (assuming they really KNOW the law) hoping they will get away with it. When they get beat up, as in this case. they STILL get paid. How is that? The rule should be that if you get beat by a Judge who KNOWS the law, you should not get paid, either because you tried to slip something by and failed, or because you are stupid. Fail.
Your right Bruce, also one breaching there oath of office IS a federal crime, but no one is arresting them, that law is in ( Title 5 U S C Section 7311 and 1333 ) look it up the one breaching there oath is to be removed and also can get orison time to !
It is unfortunate that we conservatives have to measure Constitutional success with such small victories. The Congress, the President and the Judicial (federal Supreme Court) take an Oath of Allegiance to the Constitution to protect and defend the Constitution and the United States of America. Why are the citizens of this nation constantly under attack by all three branches for what the Constitution stands for? Why? Why do we fear our government? Why can a hand full of people driving the country? When I grew up in the 1950s and 60s freedom was king! Now freedom is a struggle. I can be jailed for speaking my mind. In England you are arrested for standing across from abortion center with closed eyes because you are suspected of praying. In Canada you are arrested and jailed for supporting striking truckers (just serving them coffee and your entire family loses every asset and bank accounts seized). In Finland an elected official is arrested for posting Bible verses on line that call homosexuality wrong (sin). Our children are kidnapped by the State and butchered and there is nothing you can do as a parent. It’s all coming here if the Democrats remain in power. God help us. The anti-gun people don’t care about the law or constitution , they evidently can’t read plain text ( not to be infringed ) It’s just like concealed carry permits, it is just extortion by the states, there is nothing in the second amendment that demands how you carry a weapon or that you have to pay to do something that is your right.
