Did The ATF Just Make You A CRIMINAL With This Move?

If you’ve been a regular reader of this site for any amount of time, then you know that we aren’t really fans of the Bureau of Alcohol, Firearms, Tobacco, and Explosives (ATF). Now, it’s not because the ATF is only staffed with bad people. There are both good and bad people in any legitimate occupation (that excludes organized crime, etc.).

No, our issue with the ATF is that the ATF tries to limit the Second Amendment, and the Second Amendment is written in such a way that it is clear that there aren’t limits on it, that it gives the right for all Americans to own firearms.

To further add fuel to the fire, the ATF keeps trying to further restrict Americans’s Second Amendment rights with incremental decisions on their part which completely bypass the legislative process. These decisions are theft of Americans’s rights without any voting by our representatives or court battle (at least, not until the decision is challenged by the minority of Americans who are actually paying attention).

Which leads us to today’s exhibit of the ATF trying to make everyday law-abiding Americans into criminals. Did their recent decision just make you a criminal, too? Caleb Giddings gives us the details of this infuriating decision:

Yesterday, the ATF sent a letter to Federal Firearms Licenses. This clarified that “some” forced reset triggers (FRT) are in fact machine guns.

Below are selections that Giddings shared from the ATF’s letter.

These particular FRTs are being marketed as replacement triggers for AR-type firearms. Unlike traditional triggers and binary triggers (sometimes referred to generally as “FRTs”), the subject FRTs do not require shooters to pull and then subsequently release the trigger to fire a second shot. Instead, these FRTs utilize the firing cycle to eliminate the need for the shooter to release the trigger before a second shot is fired.

Accordingly, ATF’s position is that any FRT that allows a firearm to automatically expel more than one shot with a single, continuous pull of the trigger is a “machinegun”, and is accordingly subject to the GCA prohibitions regarding the possession, transfer, and transport of machineguns under 18 U.S.C. §§ 922(o) and 922(a)(4). They are also subject to registration, transfer, taxation, and possession restrictions under the NFA. See 26 U.S.C. §§ 5841, 5861; 27 CFR 479.101.

Based on ATF’s determination that the FRTs that function as described above are “machineguns” under the NFA and GCA, ATF intends to take appropriate remedial action with respect to sellers and possessors of these devices. Current possessors of these devices are encouraged to contact ATF for further guidance on how they may divest possession. If you are uncertain whether the device you possess is a machinegun as defined by the GCA and NFA, please contact your local ATF Field Office. You may consult the local ATF Office’s webpage for office contact information.

Now, this decision by the ATF may not affect a huge number of Americans at this point, but the problem with this decision for people who don’t own firearms with forced reset triggers is that allowing this kind of overreach to go unchallenged will only embolden the gun control zealots embedded in portions of the ATF to keep trying to strip away Americans’s rights.

He got denied the directorship of the ATF, but there are other nutcases like him still there, and we can’t let them gain any ground. No, we need to deny them, through all legal, moral, and ethical means, any attempts at taking Americans’s rights, and those people need to be removed from employment from the ATF.

Americans’s rights are not the government’s to take.

  1. This is direct fallout from the changes to the definitions of semi-automatic and automatic that Mr. Trump gave us.

  2. If DeSantis runs for president Trump will most likely lose. Romney needs to go back to his crying corner and hopefully the dog he tied to the top of his car will bite him in the ass.

  3. And now they’re going after so called ghost gun parts in that all parts will now have to be serialized. They are certainly going out of the way to legislate the 2nd amendment out of existence without fully wiping the 2nd amendment from the constitution/bill of rights

  4. The government or any of its agency’s are forbidden anything against arms by the Constitution …
    The 2nd.Ammendment A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
    “” A well regulated Militia, being necessary to the security of a free State, “”, Every state needs some form of armed defense and that force needs replacements : hence :”” the right of the people to keep and bear Arms, “” Then it makes sense that the PEOPLE are those replacements so they have the right to be armed …
    Now the big one “” shall not be infringed. “” Which means every law or regulation is DECLARED UN-CONSTITUTIONAL by the Constitution itself …
    The Constitution covers every inch of the United States …

    • Very well spoken! You are very right on this that is exactly why our Forefathers put that in the Constitution. Because they new we would someday run into a corrupt government in which we have today. So to all true Americans just know that there is no law that can take our rights from us. See the demonrats want to disarm America so they can have full control look at all the other countries in the world that took the guns from the people now they can’t defend themselves. Well I have something to say I am a law abiding citizen and if I had a gun I would Not let any corrupt politicians take it from me. Because that would be my right.

  5. Have none of you ever read a paper or listened to the news on TV. Killings and gun crime are blanketing the country. It is time to find a way to insure that those who own and carry guns are capable of doing so appropriately. We need some amendments to the Second that insures we can control the unlimited gun ownership to those who will not abuse it!!!

    • What is that you don’t use? It’s criminals who are committing the crimes, not law abiding citizens. These laws do nothing from stopping criminals from obtaining guns if they want them. All the laws do is criminalize law abiding citizens. Duuhh!!

  6. In response to Mr. R.Triers’ comment, I fully agree with these rights, and liberties bestowed upon us by the founding fathers.
    This is beyond debate by logical citizens, yet you’ve applied the use of the word “sense” in your statement. And that simply will never relate to any attempt of action or attack, against our 2nd amendment rights.

    • The Second Amendment is GUARANTEED by the Founders of our Constitution. They are GIVEN by God.

  7. This is literally because there is a Demorat in the Whitehouse . The ATF Like any other federal agency/ FBI,DEA, Army ,Marines ,etc takes its marching orders literally from the man at the White House. Even if there was a captain at the helm of the ATF, he do whatever the President that appointed him wants. There is the danger of an agency following orders rather the constitutional law !
